LIEN AVOIDANCE

Represented an individual debtor in a Chapter 13 case (Case No. 23-30555) in the U.S. Bankruptcy Court for the Northern District of California. The filing stayed collection efforts by a judgment lien creditor and set the stage for affirmative relief against the lien itself.

Through a valuation motion under 11 U.S.C. § 506(a), the firm established that the judgment lien was unsupported by value in the debtor’s property and obtained an order avoiding the lien — reducing what had been a secured claim to general unsecured creditor status and stripping the creditor of any lien-based recovery rights. The Chapter 13 plan was confirmed on July 19, 2024.

Result: Judgment lien avoided under § 506(a); creditor reduced to general unsecured status; Chapter 13 plan confirmed (July 19, 2024).
